Terms and Conditions

Happy Birthday Text

  1. Will provide reminders by text and email to the signed up user of Happy Birthday text.
  2. The cost of the service is:
    1. £5 for up to 20 Reminders & Greetings - This is annually renewable.*
    2. £20 for up to 100 Reminders & Greetings – This is annually renewable.*
    3. A joining fee of £10 – This is a one off payment upon joining the service.
    4. If a user wishes to add additional contacts over and above the packages outlined in 2a or 2b, these will be added at £1 in batches of 10 Reminders & Greetings.
    5. Happy Birthday Text reserves the right to amend the cost of the annual packages and will inform users of that change in pricing at the time of informing users of the renewal period.
    6. Happy Birthday Text reserve the right to change the terms and conditions before renewal of any contract
  4. The term of the contract between Happy Birthday Text and the user is 1 year on a rolling basis.
  5. A renewal email will be sent 30 days before auto renewal via PayPal is requested or as is reasonable.
  6. Happy Birthday Text reserve the right to terminate any contract on notification of the user for any abuse of the system or infringement of terms.
  7. Happy Birthday Text operates for UK based mobile phones. Where a user opts to include contacts outside of the UK mobile phone network, Happy Birthday Text will charge the user as if 2 contacts from their package have been used.

General Terms and Conditions

Happy Birthday Text shall not under any circumstances be responsible to the Client or any third party in the event that:

  1. Any of the services is affected by court order or legal process or any rule, regulation or guideline that is recommended in the telecommunications or electronic media industries.
  2. Any failure howsoever arising from a breakdown of computer equipment or any server or electronic process, including, without limitation, any failure of third party mobile telephones, any text messaging software, equipment or SMS services.
  3. For any act of force majeure; being any act of god, strike, lock out or any other reason beyond the control of Happy Birthday Text.
  4. If a dispute should arise concerning the operation of this service which Happy Birthday Text or the Client are unable to resolve, either Happy Birthday Text or the Client may at any stage refer the dispute to an independent third party to be agreed by the Client and Happy Birthday Text ( or in absence of agreement within one week of notice from Happy Birthday Text or the Client, to be appointed by the President for the time being of the Law Society of England and Wales ) who acting as expert and not arbitrator can to resolve the matter. Any decision made by such third party shall be made in writing and delivered to the Client and Happy Birthday Text.

Acceptable Usage

In using this Service you agree to the following:

  1. Users may not send messages, upload, email, transmit or otherwise make available any messages or content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
  2. Users may not send messages, upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contract;
  3. Users may not send messages, upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
  4. Users may not send messages, upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, 'junk mail,' 'spam,' 'chain letters,' 'pyramid schemes,' or any other form of solicitation that is contrary to the laws and regulations of the UK.   5. Users may not send messages, upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
  6. Users may not interfere with or disrupt The Service or servers or networks connected to this service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
  7. Users may not collect or store personal data about other users in connection with the prohibited conduct and activities set out in the previous paragraphs. This service is specifically designed as a Birthday reminder service and a service which delivers Birthday and celebration greetings.
  8. Users storing personal data in Contact Lists or elsewhere in the Service are responsible for complying with the relevant Data Protection and Freedom of information Legislation. For more information see www.ico.gov.uk/
  9. All messages, information, software, music, sound, graphics or video sent or uploaded through or stored in The Service, is for private use and is the sole responsibility of the person who originated the material.
  10. Under no circumstances is The Service responsible for any content that is offensive or objectionable, or for any loss or damage that may result from any content transmitted through the service.
  11. We reserve the right to screen content and have the discretion to refuse any content that is considered unacceptable. Any serious or consistent breach of the Terms and Conditions or Acceptable Usage Policy will result in the immediate suspension of the user account and the loss of message credits for that account.
